Summary

Captive Wildlife Safety Act - Amends the Lacey Act Amendments of 1981 to define "prohibited wildlife species" as any live lion, tiger, leopard, cheetah, jaguar, or cougar.Declares it a prohibited act for any person to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce any prohibited wildlife species. Exempts from this prohibition licensed zoos, circuses, accredited sanctuaries, federally-licensed breeders, State entities (universities, wildlife rehabilitators or veterinarians), any incorporated humane society, animal shelter, or society for the prevention of cruelty to animals, persons transporting prohibited wildlife species to any such facility, and specified related organizations.
Captive Wildlife Safety Act - Amends the Lacey Act Amendments of 1981 to define "prohibited wildlife species" as any lion, tiger, leopard, cheetah, jaguar, or cougar species, or any hybrid of a lion species and tiger species. Declares it a prohibited act for any person to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce any live animal of a prohibited wildlife species. Exempts from this prohibition: (1) persons with expertise, knowledge, and experience with respect to the care of that species in captivity; (2) persons licensed and inspected by the Animal and Plant Health Inspection Service with respect to that species; (3) a State college, university, or agency, a State-licensed wildlife rehabilitator, or State-licensed veterinarian; (4) an accredited wildlife sanctuary that cares for prohibited wildlife species; or (5) persons that have custody of the animal solely for the purpose of transporting it to such persons described in this Act with respect to the species.

Exempts from this prohibition: (1) persons licensed or registered, and inspected, by the Animal and Plant Health Inspection Service or any other Federal agency with respect to that species; (2) a State college, university, or agency, a State-licensed wildlife rehabilitator, or State-licensed veterinarian; (3) an accredited wildlife sanctuary that cares for prohibited wildlife species and is a tax-exempt nonprofit corporation that does not commercially trade in the species, including offsprings, parts, and byproducts of such animals or propagates them, nor allows direct contact between the public and the animals; or (4) persons that have custody of the animal solely for the purpose of expeditiously transporting it to a person described in this Act with respect to the species. Authorizes appropriations for FY 2004 through 2008.
