Summary

Continuing Appropriations Act, 2012 - Makes continuing appropriations for FY2012. (Sec. 101) Makes appropriations for continuing operations, projects, or activities which were conducted in FY2011 and for which appropriations, funds, or other authority were made available in: (1) the Department of Defense Appropriations Act, 2011 (division A of Public Law 112-10); and (2) the Full-Year Continuing Appropriations Act, 2011 (division B of Public Law 112-10). Reduces the rate for operations by 1.503%. (Sec. 102) Prohibits the use of appropriations, funds, or authority granted under this Act for the Department of Defense (DOD) for: (1) new production of items not funded for production in FY2011 or prior years; (2) the increase in production rates above those sustained with FY2011 funds; or (3) the initiation, resumption, or continuation of any project, activity, operation, or organization for which appropriations, funds, or other authority were not available during FY2011. Bars the use of DOD appropriations, funds, or authority granted under this Act to initiate multi-year procurements utilizing advance procurement funding for economic order quantity procurement unless specifically appropriated later. (Sec. 104) Prohibits the use of appropriations, funds, or authority granted by this Act to initiate or resume any project or activity for which appropriations, funds, or other authority were not available during FY2011. (Sec. 106) Provides funding under this Act until whichever of the following first occurs: (1) enactment of an appropriation for any project or activity provided for in this Act; (2) enactment of the applicable appropriations Act for FY2012 without any provision for such project or activity; or (3) October 4, 2011. (Sec. 111) Continues through October 4, 2011, certain activities for entitlements and other mandatory payments whose budget authority was provided in FY2011 appropriations Acts, and for activities under the Food and Nutrition Act of 2008. Declares that, notwithstanding such date, funds shall be available and obligations for mandatory payments due on or about the first day of any month after October 2011 but within 30 days after October 4, 2011. (Sec. 112) Authorizes apportionment of amounts made available under this Act for federal civilian personnel compensation and benefits up to the rate for operations necessary to avoid furloughs within a department or agency. Prohibits the use of such authority until after the department or agency has taken all necessary actions to reduce or defer non-personnel-related administrative expenses. (Sec. 114) Designates specified funds for Overseas Contingency Operations/Global War on Terrorism, but only if the President subsequently makes such a designation and notifies Congress. Exempts from such requirement amounts for the Department of Justice (DOJ), Federal Bureau of Investigation (FBI) for salaries and expenses. (Sec. 115) Requires discretionary amounts appropriated for FY2012 provided in advance by appropriations Acts to be available in the amounts provided in such Acts, reduced by 1.503%. (Sec. 116) Authorizes the Secretary of Defense to use through October 4, 2011, certain amounts for operations and activities of the Office of Security Cooperation in Iraq and security assistance teams. (Sec. 117) Makes certain funds available for Overseas Contingency Operations at a rate for operations permitted by the Department of Defense Appropriations Act, 2012 as passed by the House of Representatives on July 8, 2011. (Sec. 118) Continues through October 4, 2011, DOD authority to pay monetary rewards for the provision to U.S. government personnel of information or nonlethal assistance beneficial to an operation, activity, or force protection for U.S. Armed Forces. (Sec. 119) Continues through October 4, 2011, DOD authority to use acquisition and cross-servicing agreements to lend certain military equipment to foreign forces in Iraq and Afghanistan for personnel protection and survivability purposes. (Sec. 120) Provides amounts at a specified rate for operations for the Defense Nuclear Facilities Safety Board for salaries and expenses. (Sec. 121) Authorizes the District of Columbia to expend local funds for programs and activities, subject to specified conditions. (Sec. 122) Provides amounts at a specified rate for operations for necessary expenses of the Recovery Accountability and Transparency Board to carry out its functions under the American Recovery and Reinvestment Act of 2009. (Sec. 123) Continues through October 4, 2011, the authority of the Small Business Administration (SBA) to carry out: (1) the Small Business Innovation Research (SBIR) Program, (2) the Small Business Technology Transfer Program, and (3) the Commercialization Pilot Program. (Sec. 124) Extends through October 4, 2011, the requirement that the U.S. Postal Service pay $5.5 billion into the Postal Service Retiree Health Benefits Fund. (Sec. 125) Provides amounts at a specified rate for operations to the Federal Emergency Management Agency (FEMA) for disaster relief. Requires the Secretary of Homeland Security (DHS) to provide a full accounting of disaster relief funding requirements for FY2012 and FY2013, including specified estimates. (Sec. 126) Authorizes the obligation of any DHS funds made available pursuant to this Act at a rate for operations necessary to sustain essential security activities. (Sec. 127) Continues through October 4, 2011, U.S. Secret Service authority to use proceeds derived from undercover criminal investigations for such operations. (Sec. 128) Continues through October 4, 2011, DHS authority to carry out basic, applied, and advanced research and development projects. (Sec. 129) Continues through October 4, 2011, DHS issued interim final regulations establishing risk-based performance standards. (Sec. 130) Continues through October 4, 2011, the authority of the Administrator of FEMA to issue notes or other obligations to the Secretary of the Treasury to carry out the flood insurance program. (Sec. 131) Continues through October 4, 2011, the authorities of Service First (a partnership authority among the Bureau of Land Management [BLM], the Forest Service, the National Park Service, and the U.S. Fish and Wildlife Service). (Sec. 132) Increases appropriations for salaries and expenses in the Mine Safety and Health Administration of the Department of Labor. (Sec. 134) Provides amounts at a specified rate for operations for the Federal Mine Safety and Health Review Commission for salaries and expenses. (Sec. 135) Continues through October 4, 2011 the authority of the Secretary of Health and Human Services (HHS) with respect to: (1) autism spectrum disorder and other developmental disabilities; and (2) autism education, early detection, and intervention. Continues through such date the Interagency Autism Coordinating Committee. (Sec. 136) Eliminates certain FY2011 appropriations for military construction for the Army, the Air Force, and defense-wide. (Sec. 137) Extends through October 4, 2011, the authority of the Export-Import Bank of the United States to provide financing for the export of nonlethal articles or services meant primarily for civilian purposes. (Sec. 138) Continues through October 4, 2011, the Commission on International Religious Freedom. (Sec. 139) Limits to a specified rate of operations any commitments to guarantee loans incurred under the General and Special Risk Insurance Funds authorized under the National Housing Act. (Sec. 140) Approves the renewal of certain import restrictions contained in the Burmese Freedom and Democracy Act of 2003, and deems this Act a renewal resolution under such Act.

Department of Homeland Security Appropriations Act, 2012 - Title I: Departmental Management and Operations - Makes appropriations for the Department of Homeland Security (DHS) for FY2012, including for the Offices of the Secretary of Homeland Security, the Under Secretary for Management, the Chief Financial Officer, the Chief Information Officer, and the Inspector General and for intelligence analysis and operations. Title II: Security, Enforcement, and Investigations - Makes appropriations for FY2012 for: (1) United States Customs and Border Protection (CBP), including for automation modernization, border security fencing, infrastructure, and technology, air and marine interdiction, operations, maintenance, and procurement, and construction and facilities management; (2) United States Immigration and Customs Enforcement (ICE), including for reimbursement of other agencies for costs associated with the repatriation of smuggled aliens unlawfully present in the United States, prioritizing the identification and removal of aliens convicted of a crime by the severity of that crime, and automation modernization; (3) the Transportation Security Administration (TSA), including for aviation security, surface transportation security, the Office of Transportation Threat Assessment and Credentialing, transportation security support, and Federal Air Marshals; (4) the Coast Guard, including for defense-related activities and designated funding for overseas contingency operations, funding for environmental compliance and restoration, reserve training, acquisition, construction, and improvements, research, development, test, and evaluation, and retired pay; and (5) the United States Secret Service, including for acquisition, construction, improvements, and related expenses. Title III: Protection, Preparedness, Response, and Recovery - Makes appropriations for FY2012 for: (1) the Office of the Under Secretary for National Protection and Programs Directorate, including for infrastructure protection and information security programs and activities, the Federal Protective Service, and the United States Visitors and Immigrant Status Indicator Technology Project (US-VISIT); (2) the Office of Health Affairs; and (3) the Federal Emergency Management Agency (FEMA), including for grants for state and local programs, firefighter assistance grants, and emergency management performance grants, the United States Fire Administration, the Disaster Relief Fund (including a specified amount for expenses resulting from a major disaster designation pursuant to the Robert T. Stafford Disaster Relief and Emergency Assistance Act [Stafford Act]), the disaster assistance direct loan program account, the flood hazard mapping and risk analysis program, the National Flood Insurance Fund, the National Pre-Disaster Mitigation Fund, and the emergency food and shelter program. Title IV: Research and Development, Training, and Services - Makes appropriations for FY2012 for: (1) United States Citizenship and Immigration Services (CIS), including for immigration verification programs, including the E-Verify program to assist U.S. employers with maintaining a legal workforce; (2) the Federal Law Enforcement Training Center; (3) the Office of the Under Secretary for Science and Technology; and (4) the Domestic Nuclear Detection Office. Directs the Secretary to submit a strategic plan of investments necessary to implement DHS's responsibilities under the domestic component of the global nuclear detection architecture. Title V: General Provisions - (Sec. 501) Sets forth limitations and prohibitions on the availability, use, reprogramming, or transfer of funds for specified programs and activities under this Act. (Sec. 513) Prohibits the use of funds available in this Act to amend the oath of allegiance required under the Immigration and Nationality Act. (Sec. 516) Requires specified funds appropriated or transferred to TSA for FY2004-FY2005 that are recovered or deobligated to be available only for the procurement or installation of explosives detection systems and air cargo, baggage, and checkpoint screening systems, subject to notification. (Sec. 521) Prohibits the use of funds to enforce provisions of the Intelligence Reform and Terrorism Prevention Act of 2004 regarding the prohibition against air passengers carrying butane lighters unless the Assistant Secretary (TSA) reverses the determination of July 19, 2007, that butane lighters are not a significant threat to civil aviation security. (Sec. 524) Prohibits the use of funds by CIS to grant an immigration benefit unless the results of required background checks have been received and do not preclude granting the benefit. (Sec. 526) Prohibits the use of funds to approve a waiver of the navigation and vessel-inspection laws for the transportation of crude oil distributed from the Strategic Petroleum Reserve until the Secretary takes adequate measures to ensure the use of U.S. flag vessels. (Sec. 532) Prohibits the use of funds for CBP to prevent an individual from importing a prescription drug from Canada if: (1) such individual is not in the business of importing a prescription drug; and (2) such drug complies with specified provisions of the Federal Food, Drug, and Cosmetic Act and is not a controlled substance or a biological product. Makes this section applicable only to individuals transporting on their person a personal-use quantity of the prescription drug not exceeding a 90-day supply. (Sec. 534) Prohibits the use of funds made available in this Act for planning, testing, piloting, or developing a national identification card. (Sec. 535) Requires the FEMA Administrator to submit to specified congressional committees, and publish on the FEMA website, a report regarding a decision to declare a major disaster, summarizing damage assessment information used to determine whether a major disaster exists, subject to redaction of information that would compromise national security. (Sec. 539) Prohibits the use of funds under this Act to transfer or release to or within the United States Khalid Sheikh Mohammed or any other detainee who is not a U.S. citizen or a member of the U.S. Armed Forces and who is or was held on or after June 24, 2009, at the U.S. Naval Station, Guantanamo Bay, Cuba, by the Department of Defense (DOD). (Sec. 548) Requires any company that collects or retains personal information directly from any individual who participates in TSA's Registered Traveler program to safeguard and dispose of such information in accordance with specified requirements. (Sec. 550) Requires the Assistant Secretary of Homeland Security to submit a report that certifies that a requirement for screening all air cargo on passenger aircraft has been met or that includes a strategy to comply with that requirement. (Sec. 558) Increases the limit on the airline passenger security fee to $4.00 (currently $1.50) per enplanement in air transportation or intrastate air transportation that originates at a U.S. airport, not to exceed $8.00 (currently $5.00) per one-way trip. (Sec. 562) Disaster Assistance Recoupment Fairness Act of 2011 - Authorizes the FEMA Administrator to waive a debt owed to the United States related to covered assistance (federal assistance provided under the Stafford Act to individuals and households in relation to a major disaster declared by the President during the period of August 28, 2005-December 31, 2010) if such assistance was distributed based on an error by FEMA, there was no fault on behalf of the debtor, and the collection of the debt would be against equity and good conscience. Prohibits the Administrator from waiving the debt if it involves fraud, the presentation of a false claim, or misrepresentation by the debtor or any party having an interest in the claim. Requires the DHS Inspector general to report every three months assessing the cost-effectiveness of FEMA efforts to recoup improper payments under the Stafford Act's Individuals and Household Program. (Sec. 563) Provides that recipients of Small Business Administration (SBA) disaster loans for disaster-related damage to their homes may be eligible for reimbursement at the state's discretion under the Stafford Act for documented and eligible mitigation work performed on their home, subject to specified requirements. (Sec. 566) Makes specified rescissions, including specified funds from certain accounts that were transferred to DHS when it was created in 2003.

Title III: Protection, Preparedness, Response, and Recovery - Makes appropriations for FY2012 for: (1) the Office of the Under Secretary for National Protection and Programs Directorate, including for infrastructure protection and information security programs and activities, the Federal Protective Service, and the United States Visitors and Immigrant Status Indicator Technology Project (US-VISIT); (2) the Office of Health Affairs; and (3) the Federal Emergency Management Agency (FEMA), including for grants for state and local programs, firefighter assistance, and emergency management performance, the United States Fire Administration, disaster relief, the disaster assistance direct loan program account, the flood hazard mapping and risk analysis program, the National Flood Insurance Fund, the National Pre-Disaster Mitigation Fund, and the emergency food and shelter program. Title VI: Emergency Supplemental Funding for Disaster Relief - (Sec. 601) Rescinds specified unobligated balances remaining available to the Department of Energy and transfers and merges specified funds to be used for emergency disaster relief. Title VII: Spending Reduction Account - (Sec. 702) Prohibits the use of funds made available by this Act: (1) in contravention of a provision of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 restricting any government entity or official from sending to, or receiving from, the responsible federal immigration agency information regarding the citizenship or immigration status of any individual; (2) to parole an alien into the United States, or to grant deferred action of a final order of removal, for any reason other than on a case-by-case basis for urgent humanitarian reasons or significant public benefit; (3) to require an approved Transportation Worker Identification Credential (TWIC) applicant to personally appear at a designated enrollment center for the purpose of TWIC issuance, renewal, or activation; (4) in contravention of provisions regarding the deployment of federal air marshals; (5) for DHS's Climate Change Adaptation Task Force; (6) for various affiliates of the Association of Community Organizations for Reform Now (ACORN); (7) in contravention of a provision of the Immigration and Nationality Act with respect to the detention of criminal aliens; (8) to implement the determination of the TSA Administrator regarding transportation security officers and collective bargaining as described in the decision memorandum dated February 4, 2011; or (9) to implement any rule, regulation, or executive order regarding the disclosure of political contributions that takes effect on or after the date of this Act's enactment. (Sec. 714) Sets a limitation on the amount of funds made available for TSA aviation security screening operations that may be used for screener personnel, compensation, and benefits.
Department of Homeland Security Appropriations Act, 2012 - Makes appropriations for the Department of Homeland Security (DHS) for FY2012 for: (1) the Offices of the Secretary, the Under Secretary for Management, the Chief Financial Officer, the Chief Information Officer, and the Inspector General; (2) United States Customs and Border Protection (CBP); (3) United States Immigration and Customs Enforcement (ICE); (4) the Transportation Security Administration (TSA), including for civil aviation security services, service transportation security activities, the development and implementation of screening programs of the Office of Transportation Threat Assessment and Credentialing, transportation security support and intelligence, and the Federal Air Marshals; (5) the Coast Guard; (6) the United States Secret Service; (7) the Office of the Under Secretary for National Protection and Programs Directorate, including for the Federal Protective Service and the U.S. Visitor and Immigrant Status Indicator Technology (U.S.-VISIT) project; (8) the Office of Health Affairs; (9) the Federal Emergency Management Agency (FEMA), including for firefighter assistance grants, emergency management performance grants, and the United States Fire Administration; (10) United States Citizenship and Immigration Services (CIS), including for the E-Verify program to assist U.S. employers maintain a legal workforce; (11) the Federal Law Enforcement Training Center; (12) the Office of the Under Secretary for Science and Technology; and (13) the Domestic Nuclear Detection Office. Prohibits the use of funds under this Act: (1) to amend the oath of allegiance required under the Immigration and Nationality Act; (2) to prevent an individual not in the business of importing a prescription drug from importing a prescription drug from Canada that complies with the Federal Food, Drug, and Cosmetic Act for personal use; (3) for planning, testing, piloting, or developing a national identification card; or (4) to transfer or release to or within the United States Khalid Sheikh Mohammed or any other detainee who is not a U.S. citizen or a member of the U.S. Armed Forces and who is or was held on or after June 24, 2009, at the U.S. Naval Station, Guantanamo Bay, Cuba, by the Department of Defense (DOD). Requires: (1) the FEMA Administrator to submit to Congress, and publish on the FEMA website, a report summarizing damage assessment information used to make a declaration that a major disaster exists, with a national security limitation; and (2) the Assistant Secretary of Homeland Security to submit a report that certifies that a requirement for 100% screening air cargo on passenger aircraft has been met or that includes a strategy to comply with that requirement.
